The case has important implications for landlord-tenant relations with regard to Wi-Fi and other small antennas referred to as over-the-air reception devices ("OTARDs"), which are regulated by the FCC.
The rule - known as the Over-the-Air Reception Devices Rule - preempts any state and local laws as well as community association rules that impair installation, maintenance or use of a protected antenna by: unreasonably delaying or preventing installation, maintenance or use; unreasonably increasing the cost of installation, maintenance, or use; or precluding reception of an acceptable quality signal.
For the first time, the FCC extended the protection of its Over-the-Air Reception Devices ("OTARD") rules against restrictions on the use of wireless antennas to unlicensed Part 15 networks.
