The Energy Resources Conservation and Development Commission and the energy division of the Public Utilities Commission would become part of the Department of Energy, while the Consumer Power and Conservation Financing Authority and Electricity Oversight Board would be folded into the new department or eliminated.
The new five-member board, appointed by Davis, included Michael Florio of TURN (The Utility Reform Network), one of the state's major public advocacy groups; Carl Guardino from the Silicon Valley Manufacturing Group, representing one of the state's largest groups of power consumers; and myself, the previous chairman of the state's watchdog Electricity Oversight Board and the state's electricity Green Team.
The settlement addresses specified claims made by SCE, Pacific Gas and Electric, San Diego Gas & Electric, the California Public Utilities Commission (CPUC), the California Electricity Oversight Board, the California Department of Water Resources Electric Power Fund, and the California Attorney General.
The measure, authored by Republican Assemblyman Anthony Pescetti of Rancho Cordova, would eliminate the Electricity Oversight Board and also would abolish the Consumer Power and Conservation Financing Authority, an agency created five months ago that has yet to decide how to conduct its business.
Additionally, Enron agreed to a civil penalty of $600 million against EPMI in favor of the attorneys general of California, Oregon, and Washington, the CPUC, and California's Electricity Oversight Board.
