On an annual basis, manufacturers of covered electronic devices are required to report the number of devices sold in California, reductions in the use of hazardous substances, increases in the use of recycled material and any efforts the manufacturer has made to design products for better recycling.
Under this regulation, retailers need to report the quantity of covered electronic devices, or CEDs, containing cathode ray tubes or with liquid crystal displays that they sell.
The EIA's framework also borrows from legislation like that in California, which calls for covered electronic devices to meet European Union Restriction on Hazardous Substances (RoHS) requirements.
HEWRA imposes a recycling fee "upon the first sale in the state of a covered electronic device to a consumer by a retailer," (210) and provides for a civil liability (administratively imposed) of up to $2,500 and a civil penalty (imposed by a superior court) of up to $5,000 for "each sale of a covered electronic device for which a covered electronic waste recycling fee" was not imposed.
This landmark legislation requires electronic retailers statewide to collect a small Electronic Waste Recycling Fee (between $6 and $10 on most televisions, computer monitors and laptop computers depending on size), for each covered electronic device that has been purchased.
Retailers deposit the revenue into a fund the state uses to pay authorized recyclers for dismantling the covered electronic devices, currently TVs, computer monitors and laptops with a screen size of at least 4 inches measured diagonally.
